FaceCast Terms and Conditions

1. Introduction

Welcome to FaceCast ("we", "us", or "our"). By downloading, accessing, or using our mobile application ("Service"), you are entering into a legally binding agreement with us. Please read these terms and conditions ("Terms") carefully as they affect your legal rights and obligations.


2. Acceptance of Terms

By using our Service, you agree to be bound by these Terms, our Privacy Policy, and any amendments thereto. If you do not agree to these Terms and the Privacy Policy, do not use our Service.


3. Use of Service

When using our Service, you may upload your photos to utilize our face swapping functionality. You represent and warrant that you have the lawful right to reproduce and distribute such content and that the content complies with all applicable laws and does not infringe any third-party rights.


4. Data Collection and Retention

We collect and store your photos in our database temporarily for the purpose of providing our Service. We will delete these photos when technically feasible. Please refer to our Privacy Policy for more details.


5. Limitation of Liability

We provide our Service "as is" and "as available," without warranties of any kind, either express or implied. We do not accept responsibility for any kind of damage, loss, or harm arising from your use of our Service.

In addition, we are not responsible for the misuse of any images or photos that you upload using our Service. Your use of the Service is at your own risk.


6. Legal Responsibilities

We solely provide the Service. We do not accept any legal responsibility regarding the use of our Service. By using our Service, you agree to indemnify and hold FaceCast harmless from any and all claims, damages, losses, liabilities, costs, and expenses arising out of your use or misuse of the Service or violation of these Terms.


7. Changes to Terms

We reserve the right to change or modify these Terms at any time and at our sole discretion. Your continued use of our Service following the posting of changes to these Terms will constitute acceptance of those changes.


8. In-App Purchases and Subscriptions

FaceCast offers in-app purchases and subscription services ("In-App Products"). These In-App Products provide you with additional features or content for a fee. All In-App Products acquired through our Service are subject to the payment terms, conditions, and policies of the Apple App Store from where you have made the purchase. Accordingly, you must also agree to the Apple App Store's terms and conditions.


Subscriptions are billed in advance on a periodic basis (e.g., weekly, monthly) and automatically renew unless you turn off the auto-renew feature at least 24 hours before the end of the current subscription period. You can manage and cancel your subscriptions by going to your account settings on the App Store.


Please note, any free trial period offered for any subscription will forfeit the remaining portion of the free trial upon purchase of a subscription.


Refunds will not be provided for any unused portion of any term. Deleting your account or the app does not cancel your subscription; you must use your App Store account settings.


FaceCast does not handle and is not responsible for the payment process for any In-App Products. Apple handles all payment and subscription processes, including refunds. Therefore, any payment issues or requests for refunds must be directed to Apple Support.


By purchasing In-App Products, you agree to pay all fees and applicable taxes incurred by you or anyone using an account registered to you. FaceCast may revise the pricing for the goods and services it licenses through the Service at any time.
