FaceCast Terms and Conditions

1. Acceptance of Terms

Welcome to FaceCast, a mobile application provided by Vision Labs Yazılım Hizmetleri Anonim Şirketi ("Vision Labs", "we", "us", or "our"). By accessing or using FaceCast, you agree to be bound by these Terms of Use, our Privacy Policy, and any additional terms that may apply to specific features of the Service.

If you do not agree to these Terms of Use or our Privacy Policy, do not use the Service.

2. Description of Service

FaceCast is an AI-powered mobile application that enables users to create, modify, and generate visual content, including face-swapping and related photo editing or transformation features. We may add, modify, suspend, or remove features at any time.

3. Use of Third-Party AI

Some features of the Service rely on third-party AI and cloud service providers to process your uploaded content and generate outputs. By using those features, you acknowledge and agree that your uploaded content may be transmitted to such providers solely as necessary to provide the Service.

Any such third-party processing is governed by our agreements with those providers and our Privacy Policy.

4. User Content

When using the Service, you may upload photos, images, prompts, and other content ("User Content").

You retain ownership of your original User Content. However, by uploading or submitting User Content through the Service, you grant Vision Labs a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and use that User Content as necessary to operate, maintain, improve, and provide the Service.

You represent and warrant that:

you own or control all rights necessary to submit the User Content;
your User Content does not infringe the rights of any third party;
you have obtained any necessary permissions or consents from individuals appearing in your uploaded content; and
your User Content complies with applicable law.

5. Personal Information Sent for Processing

To the extent your User Content contains personal information, including face images, you acknowledge that such content may be processed by Vision Labs and its service providers solely for the purpose of providing the features you request.

We do not permit our third-party AI providers to use your uploaded content for unrelated purposes such as advertising or profiling. Additional details are provided in our Privacy Policy.

6. Acceptable Use

You agree not to:

violate any applicable laws or regulations;
upload unlawful, harmful, abusive, deceptive, or infringing content;
upload content without the rights or permissions necessary to do so;
impersonate another person or misrepresent your affiliation;
attempt to interfere with, disrupt, or compromise the Service or its security;
use the Service to create content that violates the rights, privacy, or safety of others.

7. AI-Generated Content

The Service uses AI systems to generate outputs based on your inputs. You understand and agree that:

AI-generated outputs are generated automatically and may be inaccurate, incomplete, or unexpected;
outputs may not be unique;
Vision Labs does not guarantee the accuracy, quality, legality, or suitability of any output for any particular purpose; and
you are solely responsible for your use of any generated output.

8. In-App Purchases and Subscriptions

Certain features may require in-app purchases or subscriptions. All purchases are processed by the Apple App Store or Google Play Store, as applicable, and are subject to those platforms’ terms and conditions.

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. You are solely responsible for managing your subscriptions through your platform account settings.

All sales are final except as required by applicable law or platform policy. Deleting the app or deleting your account does not cancel a subscription. Refund requests, billing issues, and payment disputes must be addressed directly to the applicable platform provider.

9. Intellectual Property

All rights, title, and interest in and to the Service, including the software, interfaces, branding, design, text, graphics, and underlying technology, are owned by Vision Labs or its licensors and are protected by applicable intellectual property laws.

Except as expressly permitted in these Terms, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from any part of the Service.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and disclose information, including when content may be processed by third-party AI or service providers.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISION LABS DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, error-free, or available at all times.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISION LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

13. Indemnification

You agree to indemnify, defend, and hold harmless Vision Labs, its affiliates, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from or related to:

your use or misuse of the Service;
your User Content;
your violation of these Terms; or
your violation of any rights of another person or entity.

14. Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if necessary to protect the Service, our users, or third parties.

15. Changes to These Terms

We may revise these Terms of Use from time to time. If we do, we will update the “Last updated” date above. Your continued use of the Service after any revised Terms become effective constitutes your acceptance of the updated Terms.

16. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ankara, Turkey.
